Marketplace terms of use

1. Acceptance and eligibility

By accessing or using the marketplace, you agree to these terms and our privacy notice. You must have legal capacity to enter into binding arrangements. If you use the marketplace for an organisation, you confirm you are authorised to act for it.

2. CarKhaana's role

CarKhaana provides technology that helps buyers discover vehicles listed by participating dealerships and contact those dealerships. Unless a service expressly states otherwise, CarKhaana does not own the vehicles, act as the seller, broker, auctioneer, lender, insurer, inspector, escrow agent, or agent of either party. A vehicle purchase or related service agreement is between the buyer and the relevant dealership or third-party provider.

3. Listings and availability

Dealerships are responsible for listing content, price, description, ownership or authority to sell, vehicle condition, legal compliance, availability, and transaction terms. We design the platform to remove unlisted, archived, or sold stock, but availability can change before the marketplace updates. Images may be illustrative or affected by lighting and screens. Buyers must verify material facts directly.

4. Verification

A “verified dealership” badge means CarKhaana has reviewed specified business identity and operating information under our onboarding process. It is not a warranty, endorsement, financial assessment, mechanical certification, guarantee of title, or promise that every statement or transaction will be satisfactory. Verification may be suspended or withdrawn.

5. Buyer responsibilities

• Inspect the vehicle and arrange an independent mechanical assessment.
• Verify identity, authority to sell, original documents, registration, taxes, vehicle identifiers, and applicable excise records.
• Review written sale, warranty, return, financing, insurance, and payment terms before committing.
• Use traceable payment methods and keep receipts and communications.
• Provide accurate inquiry information and communicate lawfully and respectfully.

6. Acceptable use

You may not scrape or harvest the marketplace at scale; bypass access controls; interfere with service operation; impersonate another person; submit unlawful, fraudulent, abusive, or misleading content; distribute malware; misuse dealer contact details; or use marketplace data to build a competing database without written permission. Normal search-engine indexing under our published crawler rules is permitted.

7. Intellectual property

CarKhaana's platform, brand, interface, software, and original content are protected by applicable intellectual-property law. Dealerships or their licensors retain rights in their vehicle media and listing content while granting CarKhaana the rights needed to host, format, distribute, and promote active listings.

8. Third-party services

Links, maps, messaging services, financial products, inspections, and other third-party services are governed by their own terms and privacy practices. CarKhaana is not responsible for an independent provider's service unless applicable law requires otherwise.

9. Disclaimers

The marketplace is provided on an “as available” basis. To the extent permitted by law, we do not guarantee uninterrupted operation, a particular vehicle outcome, listing completeness, mechanical condition, title, merchantability, fitness for a particular purpose, dealer response, financing approval, or transaction completion. Nothing here excludes a right or liability that cannot lawfully be excluded.

10. Liability

To the extent permitted by applicable law, CarKhaana is not liable for indirect, incidental, special, punitive, or consequential loss; loss of profit, opportunity, data, or reputation; or loss arising from a buyer-dealer transaction, third-party service, unauthorised payment, or reliance on unverified listing information. Any mandatory liability remains subject to applicable law.

11. Suspension and reporting

We may restrict access, remove content, suspend a dealership profile, preserve evidence, or refer a matter to authorities where reasonably necessary to protect users, the platform, or legal rights. Report suspected misuse to safety@carkhaana.pk.

12. Changes

We may update these terms as the marketplace changes. We will publish the effective date and provide additional notice where required. Continued use after an update means the revised terms apply from their effective date.

13. Governing law and disputes

These terms are governed by the laws of Pakistan. Courts of competent jurisdiction in Pakistan will have jurisdiction as applicable, subject to any mandatory consumer forum, territorial rule, or dispute right that cannot be waived.
